General Terms and Conditions (GTC)


The following terms and conditions (GTC) form the basis and integral part of every contractual agreement between Holger Haering (hereinafter referred to as "Rikscha-Mick") and the client (either an individual or as group leader). These terms and conditions will be communicated to the client prior to booking. By booking, the client automatically accepts these terms and conditions.

General All information, third-party opening hours, and information on our website have been researched and checked by "Rikscha-Mick" with the utmost care. No guarantee can be given that the information is error-free. No claim is made to completeness. These terms and conditions apply only to the services offered by "Rikscha-Mick." Should the customer's terms and conditions conflict with these terms and conditions, they are expressly and in all cases rejected. Offers from "Rikscha-Mick" are subject to change without notice unless expressly designated as binding. In the event of adverse weather conditions, operations may be restricted or even suspended completely. This includes adverse weather conditions such as persistent rain, dense fog with visibility below 100 m, temperatures below 5°C, wind force 5 or greater ("fresh breeze with wind speeds over 29 km/h), or the risk of thunderstorms, hail, and freezing rain. In this case, the client has the right to reschedule the appointment or to receive a voucher up to the amount of the paid participation fee. There is no right to withdraw from the contract. Cancellation of a booked event or tour experience due to weather conditions requires the consent of "Rikscha-Mick." Conduct on Board Our Vehicles and Refusal of a Ride: Smoking (including so-called "vaping") and the consumption of food and beverages are prohibited at all times on board our vehicles. Loud music playing by customers is also prohibited. The instructions of the rickshaw driver or tour representative must be followed at all times. When booking, the client acknowledges that violations may result in the immediate termination of the tour experience and removal from our vehicles. For insurance and design reasons, the maximum weight of the rear passenger bench of the Bayk rickshaw is 170 kg. By booking, the client acknowledges this regulation and declares that the total weight of all passengers to be transported, including their equipment and luggage, will not exceed 170 kg. A clearly foreseeable excess of this weight limit entitles the "Rikscha-Mick" rickshaw driver to refuse to transport passengers. This does not entitle the client to withdraw from the contract. Rather, "Rikscha-Mick" reserves the right to retain any participation fee already paid, in whole or in part. Alternatively, weight reduction can be achieved by transporting only one passenger. Passengers and experience participants of "Rikscha-Mick" can be excluded from all tours and events if they behave in an abusive, threatening, or violent manner towards "Rikscha-Mick" employees or - in connection with the event - towards third parties. Passengers can also be excluded from an event or tour experience if they are found to be heavily alcoholic or drug-abusing. Conclusion of contract: Contracts between "Rikscha-Mick" and the client are concluded by letter, email, telephone, or by booking on our website. Offers are subject to change. "Rikscha-Mick" undertakes to inform the client of any changes or deviations to services. Prices: Unless expressly stated in the offer description, prices for food and other entrance fees are not included in our offers and must be paid separately. "Rikscha-Mick" reserves the right to set variable prices according to demand. For example, offers may be marked cheaper or more expensive elsewhere. As a small business within the meaning of Section 19 of the German Value Added Tax Act (UStG), no sales tax is paid. All prices quoted are final prices. Payment terms


The agreed participation fee must be transferred to the account of “Rikscha-Mick” without deductions at least 1 week before the tour, unless otherwise agreed in writing.

Only in special cases and after written agreement can the participation fee for an experience be paid in cash or by electronic card payment at the start of the experience.


Cancellation policy


According to Section 312g, Paragraph 2, No. 9 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for "services related to leisure activities if the contract stipulates a specific date or period for their provision." Cancellation of the contract for agreed offers and tour experiences within the scope of Section 312g, Paragraph 2, No. 9 of the German Civil Code (BGB) by the client is not possible. If the client cancels an event or tour experience up to 12 hours BEFORE the start date, a rescheduled date or an equivalent voucher will be offered. Cancellation within less than 12 hours before the start of the booked event or tour experience will result in cancellation without compensation. A refund of the fee or the right to an alternative date or voucher is then no longer possible. In the event of a customer failure to appear, 100% of the agreed amount will be charged. Liability


The liability of “Rikscha-Mick” towards the client for damages is limited to the fulfillment of the agreed scope of services and the agreed timeframe and is limited to the amount of the participation fee, provided that the damage was neither caused intentionally nor through gross negligence by “Rikscha-Mick”.

In the case of cooperation with other partners (museums, bus transfers, restaurants, etc.), their respective liability conditions apply.

Participation in a tour is at each participant's own risk. Attendance and waiting times: If the client or a person appointed by them fails to show up for the tour or guided tour at the specified time and meeting point (maximum waiting time 15 minutes by "Rikscha-Mick"), the client's payment obligation remains unaffected. "Rikscha-Mick" undertakes to have a guide available at the meeting point for up to 15 minutes after the tour begins. After this time, the rickshaw driver or tour representative is no longer obligated to be present if the client or a person appointed by them fails to show up. If the tour starts late for reasons caused by the client, the tour will be shortened by the delay, unless otherwise agreed. In the event of a rickshaw driver or tour representative from "Rikscha-Mick" failing to appear – e.g., due to sudden illness or force majeure – the liability of "Rikscha-Mick" is limited to the amount paid by the client. Insurance


For passengers of the rickshaws of “Rikscha-Mick” there is sufficient

Liability insurance. A corresponding policy will be presented to the client upon request. Damages


Any possible claims for damages by the client against “Rikscha-Mick” are limited to compensation for typically foreseeable damages, unless there is a case of intent or gross negligence.

Scope and Jurisdiction: The place of performance is the registered office of "Rikscha-Mick." This contract is subject exclusively to German law. The place of jurisdiction for all disputes arising from or in connection with this contract is Duisburg. Should individual provisions of this contract be legally invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely approximates the intended purpose. Final Provision: The purchaser of a service accepts these General Terms and Conditions by placing an order / booking confirmation with "Rikscha-Mick."
